The actio tributoria was an actio granted by the praetor to the creditors of the subject to the power that had contracted bonds and made shops in respect of the peculiar goods granted to it by the pater familias or dominus to trade it. The third creditors, having well-founded reasons to fear bankruptcy of the subject, appealed to the praetor who called on the dominion to divide the amount of peculiar goods among the creditors by attributing to them a proportionate share of the credit of each and also participating in it breakdown on the same plane. Unlike when he acted with actio de peculio et de in rem, in which the peculiar amount to be split between the creditors was calculated net of the debts contracted by the subordinate with the potent, there was a par value creditorum with dominus.
