Maintenance obligation


Maintenance obligation is a legal obligation of someone to maintain another. The Netherlands

Spouses and registered partners have a maintenance obligation in relation to each other. Parents have a maintenance obligation for their children until they are 21 years old (even though they are 18 years old). Ex partners have a maintenance obligation if one of the partners has insufficient income to live. In some cases, payment of alimony is also based on the maintenance obligation.

Parents' maintenance obligation to maintain their childhood is written as article: 395a of Book 1 of the Dutch Civil Code.

In any case, this means that parents should ensure that the child gets the most basic things, such as shelter, clothing, nutrition, education and medical care.

Failure to comply with the duty of service, whether or not by judgment, may have criminal consequences.
