Abusus does not use tollit usum: the expression, literally translated, means abuse does not prohibit the use (maximum of antique law).
It means that one thing can be used, even if there is anyone who is abusing it, that is, excessive use or beyond the limits of lawfulness. For example, the fact that some abuse of wine does not mean that its moderate use is not legitimate.
The brocard was used by Cardinal Carlo Maria Martini in his article published on Sun 24 Hours in defense of the Italian Catholic liturgy, in opposition to dialectics to those who argued that he had abused the new Italian liturgy at the disadvantage of Latin ritual, hoped for the same reduction for a wider return to the Latin ritual.
